As the Canyon Courier reports:
Landmark Community Newspapers Inc., the parent company of the Columbine Courier, Canyon Courier and High Timber Times, filed paperwork Wednesday in Jefferson County District Court alleging the county commissioners violated the Colorado Open Meetings Law.
The lawsuit, which alleges the commissioners met July 5 with county workers to discuss the board’s future budget options without posting adequate prior notice, asks for a district judge to rule that the county did in fact violate the law by failing to post public notice of the event, as required by the Open Meetings Law…
Two of the three Jefferson County commissioners have since acknowledged that the policy-setting board violated the Open Meetings Law by failing to post public notice of the July 5 meeting.
Democratic Commissioner Kathy Hartman and Republican Jim Congrove each acknowledged after the meeting in question that the board should not have met without posting notice.
Republican Commissioner Kevin McCasky has vehemently denied that he, or the board, did anything wrong. He previously told the Courier it was “inappropriate for the press to be here.”
When asked how the public could be certain the commission is not making important decisions when it holds meetings but fails to notify the public, McCasky responded: “You can never know that.”
The trouble is, the law says differently. Unambiguously. To prevent exactly the kind of high-handed, illegal blowoff McCasky gave the Canyon Courier. McCasky has clarified once and for all which side of the law he’s on…

mccasky and congrove are being sued AGAIN????!!!! They just don’t seem to be able to understand the part about laws and rules and things actually applying to them.
I’ve been in many staff meetings with previous boards, and every time, no other commissioner would come in the room until the previous one left; they were always very professional about it, and they understood the importance of the rule. I absolutely know that this subject is covered during the New Commissioner training session that each one is given. These guys just don’t seem to care.
I thought that the board with Holloway and Lawrence was bad, but this mccasky/congrove combination is the Worst Board Ever. Historically, jeffco has been pretty much a Republican county, but aren’t there any better Republicans living in jeffco than these pathetic creeps any more?
One real shame is that the Open Records and Open Meetings laws have no teeth in them whatsoever; these guys have learned that there are no consequences to their actions, so they just get worse and worse.
A BIG thank you from me and many of the employees of jeffco to the Courier for bring this lawsuit!
The Jeffco Dems will finally get their wish – 3 Democratic County Commissioners in Jefferson County all at once. At least 2, anyway, which gives them control. Kathy Hartman can just sit back and watch those two jokers stew in their own juices. Let’s hope the Jeffco Democratic Party keeps its word and finally votes to take Jeffco to a 5 commissioner board. Spreading the power will go a long way to cleaning up the messes once and for all.
..is run by three supervisors. I was, and remain, astounded by that small number.
A Golden city council woman is suing the city for violating the open meetings law and abusing executive session rules. The attitude in this part of the world seems to be, “We know best, sometimes it’s unseemly, but putting it all out in the open would only upset the people we’re trying to help.” Staple corruption onto paternalism and you get the picture.
