In a news interview last week, Congressman Jeff Crank (R-Colo Springs) said he is very disappointed in the Supreme Court’s ruling upholding the constitutional right to birthright citizenship. Crank told Newsmax he will be meeting with House leadership to determine what steps the House can take in response.
“[I’m] very disappointed in the Supreme Court’s decision on birthright citizenship. I do think we live in an era where people are coming to the United States to take advantage of our kindness and our goodness. We do need to address this. I’m looking to the leadership – going to meet with the leadership here in the next week or so – to try and figure out where we go and how we do react to this Supreme Court ruling.”
Crank’s deference to the executive branch, specifically President Trump’s attempt to rewrite the Constitution via executive order, is notable given his current role as a member of the legislative branch, and his previous statements describing the legislative branch as first among equals.
In 2023, back when Crank was a podcaster for Americans for Prosperity, he and AFP Vice President Casey Maddox discussed America’s foundational document as part of their celebration of Constitution Week. Crank characterized Article I, which establishes Congress, in the following manner:
“It’s not an accident if you read The Federalist Papers and and other documents that Article I is the legislative branch, right? It would have been the king if they were doing this in Britain, potentially,” said Crank. “But you know they very much wanted that legislative branch to be — they’re all separate but equal branches — but they sort of set Article I up there and again, that’s not a coincidence that they did that, right?”
Crank’s office did not respond to an email inquiry as to whether he has set a meeting with leadership yet, or which actions he believes Congress should take in light of SCOTUS upholding the constitutionality of birthright citizenship. This article will be updated with any response received.
Crank isn’t the only GOP member of Colorado’s delegation upset by the justices upholding a 157-year-old law. Immediately following the ruling, U.S. Rep. Boebert took to X to call on the State Dept. to stop allowing pregnant travelers into the country, despite the fact that so-called birth tourism, or coming to the U.S. in order to give birth here, is already illegal.
Congressman Evans, who represents the most Hispanic district in the state, did not respond to a CTR email requesting comment and he has yet to comment publicly on the recent ruling. Immediately after Trump issued the executive order last year, however, Evans released a statement citing a need to secure the border in order to prevent “massive illegal immigrant caravans exploiting birthright citizenship.” Since then he has repeatedly refused to oppose the executive order.
