This is the court case I see happening.
Why? It’s simple…Penry is too busy promoting himself, that he sometimes forgets the laws that are established to protect the media…copyright laws.
As a candidate for Governor, Penry should know that what he posts doesn’t violate these laws. Which has been up for several days. Case in point:

Now, just to ensure what I typed was correct, I called 9News and they verifyed that they don’t authorize the use of their broadcast for any purpose, including campaigning. And their website states the following from 9News.com:

This Site and all the materials available on the Site are the property of us and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. You may, however, from time to time, download and/or print one copy of individual pages of the Site for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices. However, they can link to 9News.com.
Needless to say, Penry didn’t get the authorization from 9News to post on his website and is, indeed, violating federal copyright laws.

Since you’ve posted this, at last count, in FOUR different diaries, the replies are going to be scattered. But here’s what I already wrote in the open thread.

Since the 9News.com website allows its videos to be embedded on other sites, how is this a violation?
did you call and get verification that Penry is violating copyright law by embedding video from 9News and if so, who did you speak to?
As the video is actually still on the 9News site, does this even fall in the category of making a copy?
embeds a Blip.TV version of the video, while the Buck, Frazier and Bennet campaigns look like they’re embedding directly from the 9News site. So there could be a question about copying and repurposing, though the video appears to be identical to the usual “Your Show” excerpts except that it’s got a slightly different frame and takes up more screen space than the usual embed.
9News’ reservation of rights includes “post[ing]” material from its site, which might encompass simple direct embeds. Since “Your Show” goes out of its way to encourage embeds a lot of places, though, it’s a good question whether embedding clips falls under fair-use.
My suspicion is 9News (and its parent, Gannett) means to forbid using video in campaign commercials, which could imply endorsement, not simple linking or embedding on Web sites. But if 9News intends to forbid any embedding for commercial (or campaign) purposes, they’ve got a LOT of clamping down to do — their video embeds show up on all sorts of commercially oriented sites, too.
Content providers want this stuff embedded onto other sites. It’s an easy way to get your brand viewed all over the place. If they didn’t, they wouldn’t provide embed codes.
Sorry this newfangled internet stuff is so confusing.

And Sunday’s show with Bennet and Penry was quite good, Adam although I found Penry’s answers to specific issues almost absurdly vague. I would have liked to hear some concrete solutions and suggestions to the problems you mentioned that are plaguing our state. Instead, I heard an extended campaign commercial. You can lead a horse to water, I guess…
That is Josh Penry. He’s the same way in the state senate, and he was the same way when he was pushing the idiotic Amendment 52. All rhetoric, and no solutions.
And I do mean that. I was hoping for some real dialogue to get an idea what he stands for. So far, I haven’t got the faintest idea. He dodged every question Adam asked him and Adam got pretty specific so it wasn’t for a lack of trying on his part.
