  1. Obfuscation from the NYT & WaPo. Clarity from EmptyWheel.

    This indictment will be measured not by what Maggie and Mike and Devlin and Dawsey claim about legal statutes they haven’t bothered to explain.

    It will be measured by whether the government presents evidence to prove the elements of offense for each charge beyond a reasonable doubt.

    Here, in abbreviated form, is what the elements of the offense are for the four charged crimes, which is what the jury will be given to judge the former President’s crimes. DOJ will need to prove that Trump entered into three parallel conspiracies with his alleged co-conspirators, then show that they attempted to:

    • Use deceit to undermine the Electoral College Act
    • Prevent the certification of the Electoral votes on January 6
    • Prevent the Biden voters votes in swing states from being counted
    1. On the other hand, putting Trump on trial is certainly a major question, and by application of the Roberts Major Question "Doctrine", the executive branch has no standing, and only the Supreme Court can decide on Trump's guilt.

      In other news, the Ratfucking No Labels group is working in certain swing states to swing the election to Trump.

    Rochelle Galindo … has thrown her hat into the ring for state representative of House District 4, a northwest Denver legislative district. despite a long history of ethical and legal problems.

    1. I remember her. She resigned her Statehouse seat before she could be recalled, over allegations of providing alcohol to a minor; a charge of which she was cleared. She’s apparently moved down from Greeley, where she served before.

Galindo was acquitted of that charge, as well as the sexual assault charge, which was literally “ginned up” by Sherrie Peif of Complete Colorado plying Galindo’s former girlfriend with drinks and recording her story in order to get a scoop. I notice that davebarnes quoted Peif verbatim. Way to source, daveb.

    Peif claimed the info on the alleged sexual assaults was obtained when Peif was  “contacted anonymously”. She never provided a source for the allegations, and Greeley police eventually dismissed all charges.

    Too late to limit the damage to Galindo, though. She was also targeted by the oil and gas industry, and the homophobia was layered on as a sauce. 
     

    Galindo was elected in 2018 by a wide margin and reportedly served her dostrict well. I ‘ve livd in Westwood in State HD4, and I think Galindo’s progressive politics and voice as a queer, working class Latina would be a good fit for the district.
