Boulder's ex-mayor: a smelly squatter?

The web site Boing Boing alerted me to a story taking place in Boulder that I haven’t been following, although it’s made its way extensively into local news.

From the Denver Post:

“More than 200 people protested outside the home of a couple who added more than 1,400 square feet of their neighbors’ land to their own property using a centuries-old legal doctrine.

“Some protesters carried signs Sunday outside the home of Richard McLean [former Boulder mayor] and Edith Stevens that read, ‘You’ll never enjoy a stolen view.’ Others yelled ‘shame’ and ‘thief.'”

  1. But, from what I’ve read, all I have to say is: Sucks to be the Kirlin’s…

    McLean capitalized on an ancient law…good for him.  Is it “right” or “fair?”  Probably not, but it’s the law…

  2. do the Kirlin’s lose 1/3 of their land to their neighbors in a land grab, the Kirlin’s also need to pay for the rich bastards’ legal expenses…

    Phew, the ol’ maxim is true, money begets money.

    In this case money begets a pretty awful stink too.

    1. From what I gather, the Kirlins make their living by owning a bunch of state of the art military jets, which they rent out for training and recreational flights. They are flat out loaded. MacLean and Stevens are long time public employees with some private law practice as well.

      No comparison.

      1. I hope you are not saying that because the Kirlins happen to be rich that this isn’t any less outrageous.  They got the shaft from MacLean and Stevens, and it is totally, totally wrong.

  3. If you live in Boulder and your neighbor was/is a judge, be wary. Be very, very wary.

    “Former Boulder Judge Richard McLean and his wife, lawyer Edith Stevens, won one- third of the Kirlins’ vacant land in south Boulder by using the law. McLean and Stevens argued that they had used part of the 4,700-square-foot lot to reach the garden and deck of their home virtually every day for 25 years.

    “The Kirlins bought the land in 1984 and planned to build a retirement home there.

    “The case law cited throughout Boulder District Judge James C. Klein’s ruling, Smith vs. Hayden, also involved a judge taking a neighbor’s property.

    “At the time of the case in 1989, Donald P. Smith was a state appeals-court judge. He acquired a 20-foot swath the length of a neighbor’s half-acre lot that he had used as a driveway to his weekend home in Buffalo Creek.

    “In another case, former Boulder County Judge Marsha Yeager used the law to seize a 100-foot-long stone fence that was built as an architectural component of a neighbor’s stone home on Seventh Street.”
