Attorney General Won't Prosecute Trailhead Group

No surprise here — you don’t bite the hand that might feed your campaign later. From the Rocky Mountain News:

Attorney General John Suthers’ office on Tuesday declined to prosecute a Republican group for sending out mass, pre-recorded phone calls that Democrats have called slanderous and illegal.
The calls were paid for by the Trailhead Group, a political organization that GOP Gov. Bill Owens helped found last year.

The automated calls target several Democratic lawmakers, implying they broke or skirted the law because unidentified donors paid for mailings to their constituents…

…Colorado Democratic Party Chairwoman Pat Waak filed a complaint with the Republican attorney general. She and other Democrats say they think the calls violated a state law that “prohibits the knowing or reckless dissemination of a false statement designed to affect the vote on any issue.”

The attorney general’s office disagreed. “It is our opinion that the statements made by Trailhead which resulted in this complaint do not rise to the level of reckless disregard . . .,” Deputy Attorney General Jeanne Smith concluded.

The attorney general’s decision came on the same day Democrats on a liberal blog urged each other to support resolutions at their precinct causes Tuesday night urging Suthers to investigate the calls.

  1. Yeah, people should check Mitch Morrisey’s reports too, since he declined to investigate. I guess he doesn’t want to bite the hand that feeds either. Wait…he’s a Democrat. Isn’t there any DA willing to investigate? They must all be under the thumb of Trailhead. The horror!

  2. I love when the D’s talk about Trailhead’s donors and Les when he talks about Suthers donors.

    I wish the R’s could talk about Research and Democracy’s donors, but we can’t because they are “unidentified donors.”

    Now, they’ll come after me for reckless statements, right?

  3. Re “unidentified donors”
    How about the Independence Institute’s donors?  Shall we talk about them again?  Remember the courts actually decided after the last election that they didn’t have to disclose because of their “claim” that they were doing education.  Turn about is fair-play huh?

Trailhead’s simply calling out the Dems on secret mailers.  Research & Democracy’s gifts might be legal, but not disclosing names is clearly bad government.  Common Cause has called for these in-kind gifts to be banned.  Trailhead zinging the Dems for these gifts pails in comparison with the tactics Gill, Stryker, Polis, Bridges employed against countless Republicans in 2004.

  5. See, “reckless” means “without reckoning”.  Since Trailhead did this with a lot of reckoning, it can’t be “reckless disregard”.  (snark)

    (in reality, “reckless disregard” means “complete indifference to the safety and rights of others”, but again, it’s not so much indifference, its active malice in this case…)

    So how’s Mr. Suthers’ campaign finance report looking?  Any Trailhead donors on that list that might put him in a compromising position on this decision?  Or maybe one of Trailhead’s founders did him a favor in the recent past?  Nah, couldn’t be.

  6. Well well.  What a shock!  Som the trail of slime extends to and is protected by the Attorney Generals office now.  I have always felt that this was a major flaw in our system.  There is almost nothing to stop a Demcratic AG from ignoring Republican suits and vice versa.

    NIce going John Suthers.  You suck.

    You righties can go right ahead and keep rolling about in the slime.  The fact of the matter here is that ol’ John “Bitchboy” Suthers is not doing his job.

    But no matter.  You all are goin down anyway.  This Trailhead tactic just shows how desperate your situation is getting.
