Impose a 500% excise tax at the state level on all Section 61 compensation paid to illegal immigrants and H1-B visa-holders. Make it a trust-fund tax as contemplated in the I.R.C., which means that corporate officers are jointly and severally liable for paying it. Direct the state legislature to pass conforming legislation (by way of example, to address the problem of independent contractors).
While our Congresswhores are beholden to corporate lobbyists, the people of Colorado can be counted on to vote their personal interests.
It would be an interesting legal battle. Employers could claim that the Feds have plenary control over the process, but we’re not stopping employers from bringing the H1-Bs in — just making it a lot more expensive for them to do so. But if you’re outraged at this kind of chicanery, this would be a good way to send a message to Washington, Seattle, and San Jose.
Even the Dems here should be able to get behind this one.

The state cannot under either the U.S. Constitution (which bans taxing citizens and non-citizens differently absent federal approval), or the Colorado Constitution (which mandates that the income tax be levied at a flat rate).
