The Gazette blasts Bush?

The hit parade for neo cons in Colorado keeps getting worse. The Colorado Springs Gazette is not known as the bastion of “liberal mainstream media” in America. So what did I see on the bottom of the Editor’s Opinion column this morning – a blast at Bush?

The opinion column of the Gazette is here. Let’s see:

Federal court: Seizures OK based on suspicion

Americans have gotten used to the sometimes otherworldly decisions that come out of the 9th Circuit Court of Appeals in San Francisco, which has a reputation as a leftwing hothouse. Yet we can’t recall a decision the 9th Circuit has recently made that comes close to the lunacy expressed by the 8th Circuit in the Midwest.

In essence, the court ruled last month that anyone driving with large quantities of cash must be assumed to be guilty of something, so the government can take that cash from its owner. No evidence of wrongdoing need be
found for the police to take the money and run.

Then the Gazette – same column – blasts Bush.

Bush speech comes 5 years too late

The speech President Bush gave Wednesday about terrorism was the speech he should have given five years ago. Get Congress to authorize military tribunals for suspected terrorists? Check. See to it that the lines between extreme interrogation tactics and torture are carefully drawn so those in the field don’t step over the line? Check. Make sure policies fit the Geneva Convention on detaining prisoners? Check.

It would have been a fine idea to put all these mechanisms in place shortly after the attacks of 2001, when it became clear the United States was going to war with terrorists. Getting Congress on board by authorizing military commissions and defining how they operate would have helped build support for aggressive prosecutions of prisoners. Clear policies on prisoner treatment would have helped avoid confusion by guards and interrogators — and later embarrassment for the government.

Instead, the administration operated almost exclusively by executive order, with as much secrecy as possible. Its lawyers blurred the distinction between legitimate interrogation tactics and torture, creating confusion in the field. What is striking is that beyond acknowledging that the CIA really does run secret prisons abroad, which administration flacks had previously denied, most of the administration proposals amount to asking Congress to rubberstamp the kinds of policies that got the administration in trouble in the first place.

Advocates of blurring lines — between interrogation and torture, between secret trials and fair trials — argue that the terrorists wouldn’t cut Americans such breaks. True enough. We advocate special efforts to be fair and transparent not because we expect terrorists to reciprocate but because we are Americans who believe in civilized behavior, the rule of law and the special role of this country as an example of how to succeed while doing things right.

Things are looking awfully confused down here.

  1. Actually, the seizure is consistent with federal law.  This link is testimony by the DEA explaining why they need strong seizure laws.

    The DEA can seize property based on probably cause (not guilt).  The testimony emphasizes the benefits of the program, but doesn’t really address what happens if property is seized from an innocent person.  Presumably, property isn’t often seized from an innocent person.  It also has a few paragraphs specifically discussing the DEA seizing property from Interstate travelers suspected of drug activity.

    There are procedures for innocent people getting their property back, but it does tend to put a person in a position of ‘being guilty unless proven innocent’.  That’s a significant shortcoming in the laws regarding property seizure.

    1. Carrying around large sums of money is not on its own a probable cause.  I know people who purchase cars with cash – and I mean real cash.  What’s next?  They seize the cash stuffed under some rich, paranoid hermit’s mattress?

      “Activist judges” my butt.  People who aren’t willing to stand up against authoritarian subjugation of the rights of the People are the “activists” and “appeasers”.
