Looks like the money shot in that exchange came from Texas's lawyer. Ol' Clarence's participation is noteworthy in that he usually says nothing at all during oral argument. Here, it appears he was lobbing a beach ball to counsel, under-handed, hoping the lawyer would make a point about standing. The point, of course, is that federal constitutional rules governing standing in federal courts do not apply in state courts, and that the question of whether the statute violates some standing requirement of the Texas constitution is a question for Texas state courts, not SCOTUS. Judging by that limited excerpt, the lawyer whiffed spectacularly (not that it'll make any difference to the outcome of the case).

The team isn't an estate asset. It's been owned by a trust since well before Pat Bowlen died. It's no secret that the NFL has long been displeased with that arrangement.
There was a probate proceeding in Arapahoe County District Court aimed at blowing up the trust (in part) that was scheduled to go to trial this past summer. The case settled at the eleventh hour. The terms are confidential, but word around the campfire is that a sale will occur before next season. We'll see, as there's litigation pending in another Colorado court to determine whether the Estate of Edgar Kaiser has a right of first refusal.
As an NFL exec, Elway is dumb as dog shit. However, he remains much beloved by fans. Any new owners may well keep him around for public relations purposes, but no way he'll have any say whatsoever regarding football ops.
Elway did have the prestige to lure Peyton Manning here. Other than that, he's been mostly in over his head.
