Holy Shit! Holtzman Not on Ballot

Republican candidate for governor Marc Holtzman learned Thursday night that he did not gather enough valid signatures to be assured a spot on the August primary ballot.

The Secretary of State is expected to formally announce the results tonight.

Holtzman, a businessman and the former State Secretary of Technology, promised to continue fighting.

“We will challenge this all the way up to the Supreme Court of Colorado,” Holtzman said. “We believe we’ve dotted every ‘i’ and crossed every ‘t.’ We produced more than double the number of signatures statewide.”

We spoke with Holtzman’s PR flak earlier this afternoon and asked if they were having any trouble, and the response was that they had verified their signatures in-house. “We’re not at all worried about it,” said spokesman Jesse Mallory at the time. Perhaps they do feel as though they have a legitimate challenge to the results here, which would open up another interesting subplot: Secretary of State Gigi Dennis, after all, is widely believed to be Bob Beauprez’s likely running mate.?

  2. I’s sure the Holtzman Campaign probably copied all the petitions before turning them in. They were also probably verifying the signatures with a voter database.

    If the SOS disqualified signatures for petty reasons, Holtzman might get them back on. A judge looks to see if the signer signed his name  basically correct, then they call it “Substancial Compliance” and allow it.

    A couple of years ago some petitions were challenged where the circulator admitted to filling out everything except the signers signature. The circulator didn’t date some of the petitions when it was notarized. The SOS allowed almost everything.

    About the only way a signature can be thrown out is if they aren’t Republican.

    a perfect example of MH’s twisted reality.  Hey Marc, you need 1500 in each district and they need to be valid, registered reps etc…; the total is irrelevant. 

    I guess Marc should have spent more time when he was on the road in the RV reading up on election laws.

  6. Holtzman,,, Denver City Councilwoman Carol Boigon was ruled by the Denver Election Commission to have insufficient signatures.  She hired legal help and was allowed on the ballot.  She was ultimately elected to office.  Give her a call, or call her lawyer.

    “What I have been asked to do today is the equivalent of a tax on free speech. And the second thing I would say is that it is, in my view, the political equivalent of a parking ticket, and if a $4,000 parking ticket is what it costs to stand up for working families in Colorado and to oppose that tax, I would gladly do it again.”

    SERIOUSLY????  This guy needs to be in a clinic in Switzerland, with a team of doctors working around the clock to save what’s left of his mind.  This whole “fighting for the little guy” sh1t is getting a bit tired, no?

  9. Quick note about the SoS office using temps. In years past I have been one of those temps. The lady who supervised the petition checking then is the same lady doing it this year. The temps were very well trained, many of them do this on a recurring basis. They were also told constantly “if you have any question about it, be sure to ask”. Furthermore the regular staff double checked the work of the temps, and this was after two separate temps went through the same petition. If there were any disprecencies between the two it was brought to the supervisor’s attention right then.

    It is a pretty secure method. The mistakes made in the years since this method was adopted (immediately post-Vikki Buckley) have been very few. I cannot recall a successful challenge to the SoS’s determination about any petitions (candidate or issue) since Buckley’s death in 1999.

    As for Holtzman’s petition, I’ll bet a nickel he had more than 10,500 valid signatures total, but that he missed the 1500 requirement in one or more of the congressional districts.

    I have always thought there should be grounds to challenge the “show statewide support” requirement for partisan statewide petition candidates. Petition candidates who are not Dems or GOP do not need to meet this requirement and neither do partisan candidates going through the assembly process.

  10. Isn’t it interesting?  Holtzman uses the Voter Vault Records from the Republican National Committee and conducts an in-house verification of registered Republicans only to find out that a) the list is flawed, or b) the SoS is flawed.

    What does that say if other candidates used the same data sets and ended up with different results? 

    Things are starting to smell a little like a stinky fish in the back seat.

    The only other requirement that would disqualify a signature is if the person had not been a registered Republican for a period of 29 days.  I wonder how the SoS’s office determined the 29 day period.  The date the petition was signed, when the petition was circulated, or when the petition was formally notarized?

    Interesting. 35 temps were hired, two had prior experience and we are all supposed to believe that things are well in OZ?  Give me a break.  Ask Douglas Bruce just how difficult it is to have signatures disqualified.  Bruce generally gets most of his grief trying to get past the titling phase, not the signature phase. Why?

    Simple, most judges will allow the signatures to stand if there was an honest intent by either the petitioner or the signer.  In years past, many candidates have gone the judicial route to over-ride the SoS’s office.  Holtzman won’t be the first, and certainly isn’t the last.

    If Gigi had’t gotten herself intertwined in this fiasco early one it might be believable.  Her credibility is what is at stake here.  You don’t go around endorsing people then have the responsibility to render a supposedly independent verdict.  This situation is similar to a judge who endorses a candidate, and then has to hear testimony regarding the opponent and a possible election.

    CAN ANYONE SAY: “RECUSE YOURSELF or CONFLICT OF INTEREST”?

  11. Holtzman stupidly pushed aside the olive branch extended to him.
    Marc had no volunteers and had to rely on dubious firms to gather signatures at $6 each.  The signature gathering firm will refund part of what he paid. Very slight consolation.
    Holtzman in the end had a staff that was incompetent. They were only in it for the money. Marc destroyed what might have been a bright political career. He can whine all he wants but the signatures were counted by professional staff and came up short.

  12. Holtzman missed getting 1,500 in both the 1st and the 7th, getting roughly 1,100 in each.  To get on, he will have to “cure” more than 80% of the sigs that were thrown out.  Ain’t gonna happen.

    Please Marc, grow up, move on, get married, and leave the state.  You will lose any challenge and you will only become more of a pariah than you already are.

  13. Actually I did run for SoS once in 1994 as a write-in candidate. The reason I ran was more interestng than the outcome.

    At the time the Blue Books were not mailed to every voter household (that began with the following election cycle). I was on a major “be sure about what you’re voting on” kick after the passage of Amendment 2. As an individual, the legislative staff would give me only one book, but as a candidate I could have as many as I wanted. So I signed up as a write-in candidate a few weeks before the election; got cases of the books and handed them out at every place where there was likely to be a lot of people. 

    The only “campaigning” I did was I inserted a 1/3 page bright pink home made slip into each book I gave out explaining I was a write-in candidate for Sec. of State and to please spell my name right. “Write it in, write it right” was my slogan.

    I only got 125 votes, but that was not the point. Although, I would have had many more but the Denver Election Commission made a major blunder and none of my votes in Denver county made the official count, not event the one I cast for myself! (This was before the current machines were being used).

    1) you can’t read; or
    2) you can’t add;
    3) Both.

    Holtzman according to the Denver Post:

    Where on earth did you get your numbers?  Pull them out of your – – -?  What is the likelihood that the SoS’s office screwed up with 732 signatures? Very likely.  According to my math, that is less than 3.5% approximately.  Funny. Isn’t 3 percent the legal threshold for a recount in Colorado?  Isn’t District 1 part of Adams County (Adams we failed to sign our credentials for the State Assembly delegates County)? And we don’t need to say anything more about the 7CD.

    However, just because the petitions of 4000 people didn’t have the CD District pasted on the petition does in no way invalidate the petition.  Just because someone is allergic to “HARD WORK” doesn’t make the process invalid.  I dare say that if you look at what he was short from the 4300 and challenge the 732 you will find more than enough valid signatures.

    There isn’t a judge in Colorado who will not allow the PEOPLE TO DECIDE the final outcome.  Judges always err on the side of caution.  In this case, on the side of the petitioners and not the government.

    Dare I say, if BB does go with Gigi, there will be a massive exedus of conservatives who will sit on their hands in November.  BB has already promised Pro-Lifers that he would not select Gigi as his running mate.  If he does, say hello to Mr. Governor (Bill Ritter).  Coors 2004 all over again.

    So, if 15% of all adults are functionally illiterate (that is they cannot read or add), then what is the liklihood that a portion of the temps misscalculated?  I’ll take my chances with a recount anyday.

  21. I always herd rumors to the effect that Marc had hired his fiancee to stiffle rumors that he was gay. Keep in mind that we’re talking about a guy who was asked by the Regan Library to quit using the picture of Marc with Pres. Regan and he continued to use it. Laura Teal is like many political consultants who really have no real experience campaigning, they used cookie-cutter mail pieces like the ones used on the Schaffer for Senate campaign. They were expensive but they were pointless because they weren’t to the point. I figured Marc’s campaign was gonna go the way of the Schaffer campaign and go down in flames.

  33. Whatever anyone thinks of Mark Holtzman, he worked very hard and he ran an agressive and energetic campaign. He tried to use his opposition to Ref C to garner votes but should have realized that a majority of voters, including some Republicans, voter for Ref C. He was courting a minority of voters and that is what he got. Hopefully he will try and salvage some honor and go out supporting the Republican candidate. To the Holtzman supporters, Good JOb. It is always tough to lose but you worked hard and you were loyal to the end. When you’re ready, join the team and let’s keep the mansion.

Marc will challenge and drag out the drama for a couple of more weeks.  But, the SOS office already uses a “substantial compliance” standard in counting candidate petition signatures.  Having done this several times, it seems that in recent years the SOS office is more likely to allow signatures and then, when a challenge occurs more are thrown out, not less.

    The hearing at the SOS office will be open to the public.  Too bad they can’t sell tickets-it would help with the State budget.  Oh well, the State would just have to return the money under TABOR.

I just checked the Denver Post story–MH has hired the Democrats and CEA’s hired gun lawyer for these things–Mark Grueskin.  What’s the deal Marc?  Can’t find a Republican lawyer on all of Seventeenth Street to represent you?  It wouldn’t surprise me if the CEA and Democratic Party were helping MH with his legal fees.  Hey Marc, better ask Grueskin if he is working for you or CEA on this one!

    I agree that a Republican Party is a HEALTHY Republican Party.  And while I also like your website, even though it is supportive of President Bush, you have your right to make that decision here!  That is what makes America and its ideas so very good for the world!  🙂 

    Bringing “Democracy” to the Middle East is a wonderful idea and I’m hopeful that the road to a democratic Iraq happens without any more bloodshed.  Many people misunderstand “Liberals” like myself, who stand on the side of non-violence.  It is a pleasure to have your viewpoints!!!  🙂

    President Bush in my opinion, has made critical errors in the decision to attack Iraq.  He could have arrived at the similar results with a plan that included being honest and trustworthy.  In many ways, the Democratic Party stands for “open and free” debate, whereby the Republicans stand for “control” and intimidation.  These are counter to the elements of democracy and that is why I choose to be “Liberal.”

    If President Bush would have been honest from the beginning of his term, I strongly believe that not only would we (the United States and the forces from other countries) would have suffered a fraction of the losses, but the insurgency would not have been created so strongly.  Honesty is the best policy!  Indeed, the preception of our occupation in Iraq for a forced change of your culture should have NEVER been the course of action.  Instead, we should have stood only on the side of bringing FREEDOM to your country and NEVER an encouragement of a war against “ideaology” of your rights of faith and freedom of choice. 

    I’m very hopeful that because of the Democratic Party and its Leadership, we have stood for the protection of your people, its desired freedom … as a counter to any “authoritarian” style government.

  43. ops, I should say, “… that a “DEBATING” Republican Party is a HEALTHY Republican Party!”  How did I forget the word DEBATE !!!

  44. here is why the strategy being employed by GD and BB will fail:

    1) Holtzman will simultraneously file for an Expedited Hearing under the Colorado Rules of Civil Procedure.  This will allow for a hearing in a matter of hours, and even days before a judge, or judges.

    2) The tabulation of signatures by GD and her office was flawed.  For exaqmple, what is the liklihood that Holtzman was only short signatures in 2 Congressional Districts?  Even all of the individuals who submitted signatures in the 5th CD had some thrown out.  GD is reporting that Holtzman was short in only two CD’s.  Stands to reason that he would have been short in other districts as well.

    3) GD discounted approximately 4200 signatures because they could not determine what CD they were from.  Unless I’m correct, it isn’t up to Holtzman to prove that they were from the appropriate Congressional Districts, it is up to GD and her staff to prove that they weren’t.

    4) If the petitions required that the carriers identify what Congressional District they were from, the SoS’s office should have required a column be placed on the petitions before approving them for circulation (procedural error vs. technical error).

    Just on these merits, Holtzman wins.  A similar issue arose in El Paso County in 2004.  Castlepoint HOA vs. Stiver, Groenendale, Dozier and Moreland.  A hearing was heard two days before a meeting to remove a Board of Directors member.  The court ruled in favor of the defendants and granted the Special Meeting.  The Board Director was subsequently removed.  All within a couple of days.

    Judge Richard V. Hall ruled that the parties had substantially complied with state law in their petition process and argued that the (procedural vs. technical error) onus was upon the plaintiffs to prove that the parties had not complied with state law.  Not  the defendants.  The judge also ruled that the petitions were carried in a “good faith” manner and that the technical aspects were for the plaintiffs to prove, not the defendants.

    Based up[on the above, I would say Holtzman has a more than 80% chance of getting GD over turned by the courts.  That’s what happens when you appoint people to positions of authority and they lack the experience, and/or expertise to carry out the function. 

    However, this is just a strategy by Bob Beauprez to get this way.  Instead of looking bad by challenging the signatures, he simply is having GD do the dirty work.  How else would you explain such blatant inefficiency? Or is it incompetency?

    I still thin GD should recuse herself in this matter.  Things will only get worse. Not better.

    Here is the other thing, it sounds like Holtzman was ready for this, he has not conceded defeat and lets face it, everyone knew Gigi would be hard on him. If he is able to come back, and he has before, this is going to be one more nail in the establishment coffin. The little guy getting bullied around by the big guy. All that Martinez crap backfired, and so did the lawmakers letter. That was the best publicity of Maec’s campaign. This one can be even bigger. I would wait and see before you write off MH.

Any chance he’ll challenge the state statute which keeps him from running as an independent petition candidate?  That law was written by the GOP establishment to limit the number of choices the voters get come election time.  Any chance he might head up “Republicans for Ritter/O’Brien”?  I hope we haven’t heard the last from Marky Boy yet……

    Despite the removal from the line and character assassination occurring on this thread, I’m not 100% sure this is all over yet. It sounds to me like the SOS took an easy out with the disqualifications that may not stand up in the first hour in court. And the Holtzman Campaign does seem to be chugging right along… Too soon to fly the white flag IMHO.

    For the record I do own a blue tee shirt that I will be happy to wear if need be… I’m just not sure the need be there yet.

  54. That’s why you are supposed to get 30% at Assembly Rumor.  Why bother campaigning so hard for delegation votes if the process to get on the ballot was easier (and cheaper?)

  55. Rumor Mill, you are correct but it’s an idiotic rule that cuts both way (no pun intended). A Republican may have trouble finding fellow GOP’ers in the Marxist-Leninist First C.D.  Those few Republicans who live in Denver try to be discrete and keep a low profile.  On the other hand, a Dem running statewide would need to find 1,500 Dems living in thast Fascist homeland we euphemistically call El Paso County.  It’s a pox upon both of your houses if you go the petition route…..or in the case of Marky Boy, a pox on all five of his houses!

  56. We are not talking about your opinion about whether or not MH should have gone through the caucus process. We are talking about what the petition process should be BASED on. We do have a petition process, we always will. So shouldn’t that process represent the electorate? The electorate in this case being Republicans, who are not evenly distributed by congressional district.

    Well, that cuts two ways.

    You’re suggesting that a single signature from each of CD1, CD6 and CD7 and 9,997 signatures from the remaining are representative of the state?  It sure isn’t based on the population of those districts.  That’s why the law is written the way it is.

  59. I did petition to get a new law on the ballot, I have am working on 30 issues, which will bring our state-wide total to somewhere around 500 initiatives on the ballot for November, is that right?

  60. If someone wins an election with only one vote from CD1 I think the whole state picked that person. He is still a legitimate Governor. The petition process should reflect that. it should reflect the electorate, which are repubs in this case. The law is written to be exclusive.

Who is John Galt?  The real question for you is not wether or not Laura will work in Colorado politics again.  I want to know who will hire her?  I will concede that Holtzman’s hiring of her was indeed a rookie mistake.  I think that if he had ever known just how many enemies she has made in that state and how unstable she is, he would have reconsidered.

  64. Rumor has it, that Holtzman scribbled all of the signatures from his own hand … since not one person at D.U. wanted him.  D.U. is on the Impreachment plan now.

  65. I think alot of people would hire her, sure she has enemies but in the end we are all R’s and people can kiss and make up. Laura brings alot of experience to the table and she knows the players and the people with $ in CO.  I’m a Beauprez fan myself and am glad that we can finally move on with all of this.

  66. I think the bus has been sent to the mechanichs for the next 5 years or so. I would be supprised to see her on any campaign for a LONG TIME.

  67. I for one signed the Holtzman petition outside of King Soopers after the person who was collecting signatures insisted it was okay I was registered UA. He did admit to being a paid gatherer btw.
