UPDATE #4: NARAL Pro Choice Colorado’s Karen Middleton:

“President Trump has said he will only nominate Justices who will overturn and gut Roe v. Wade, and we take him at his word. Judge Kavanaugh recently argued that a young immigrant woman, despite meeting all of Texas’ burdensome requirements to get an abortion, should not be able to exercise her right to choose to terminate her pregnancy. He has also argued against contraception coverage under the Affordable Care Act.

These arguments are not consistent with Colorado values. Colorado is a pro-choice state that strongly supports the right to choose abortion established in Roe v. Wade. Colorado’s US Senators Gardner and Bennet must not just oppose, but actively work to block Judge Kavanaugh from being confirmed to the Court.

The rights and lives of Colorado women depend on it.”

UPDATE #3: Rep. Diana DeGette:

“We are deeply concerned about how Judge Brett Kavanaugh might rule on cases involving women’s health in general, privacy, and access to the full range of reproductive care services, including abortion care – a right that since 1973 has been protected under the Constitution. Donald Trump’s actions on these matters since assuming the Presidency have been decisively anti-reproductive rights, and his administration has pushed anti-woman policies through regulations as well as nominating and installing anti-choice candidates for health-related positions. We urge the Senate to scrutinize Judge Kavanaugh closely to ensure that Americans’ fundamental rights, including the right to choose, will be protected.

President Trump’s reported short list of nominees was selected through a highly partisan process driven by a clear anti-choice agenda. Already, many are questioning the lasting damage this nomination may cause to the reputation of highest court in the land, as well the implications for Americans’ fundamental rights and civil liberties. This nomination is deeply troubling for women across the country. All Americans deserve nothing short of full transparency regarding Judge Kavanaugh’s views, intentions and attitudes toward what the Court stands for: Equal Justice Under Law.”

“President Trump continues to pursue his anti-LGBTQ agenda with his nomination of Judge Brett Kavanaugh to the U.S. Supreme Court. With this nomination, basic rights and protections LGBTQ Coloradans rely on are now at serious risk — including the ability to adopt and foster children, protection from discrimination in employment, housing, and public spaces; and the ability to get health insurance even if you have a pre-existing condition.”

“I am calling on Colorado’s U.S. Senators, Michael Bennet and Cory Gardner, to fulfill their constitutional responsibility to thoroughly and closely examine this nominee and make sure he unequivocally acknowledges and respects full equality under the law for LGBTQ Americans. The stakes are too high for this process to be rushed or taken lightly.”

UPDATE #2: Woops! President Donald Trump kept this one amazingly close to the vest all day, revealing his choice of Judge Brett Kavanaugh–an unabashedly partisan pick sure to harden battle lines–moments ago:

Kavanaugh, 53, is a judge on the US Court of Appeals for the DC Circuit and Yale Law School graduate who previously served in both Bush administrations. He also worked on independent counsel Ken Starr’s investigation of President Bill Clinton…

Democrats are warning that Trump’s nominee would jeopardize some of progressives’ most important policy priorities in recent decades — including rulings that legalized abortion and same-sex marriage, as well as former President Barack Obama’s health care law.

Republicans hold 51 seats in the Senate, though Arizona Sen. John McCain has been absent as he battles brain cancer. Trump’s nominee can win confirmation with only Republican votes, but attention will quickly shift to two moderate GOP senators, Maine’s Susan Collins and Alaska’s Lisa Murkowski, who are supportive of abortion rights.

UPDATE: News reports seem to indicate that U.S. Appeals Court (Philadelphia) Judge Thomas Hardiman is the pick. Hardiman has been described as a “Second Amendment extremist.” He is widely believed to have been the runner-up to Neil Gorsuch when Trump selected the Colorado judge to replace Antonin Scalia. Hardiman is a colleague of Trump’s sister — Judge Maryanne Trump Barry — in the 3rd District Court of Appeals.

President Donald Trump has reached a final decision on who he will nominate to the Supreme Court, two sources familiar with the matter said on Monday, just hours before the president plans to do a prime-time reveal from the White House.

The sources did not divulge who the pick will be, but sources earlier on Monday said Judges Thomas Hardiman and Brett Kavanaugh had emerged as the most likely contenders for the Supreme Court.

President Trump is expected to formally announce his choice tonight.

  1. Trump managed to choose his nominee before his announced showtime. Never happened before in the history of America; no President has managed to do it. (Make a major show spectacle out of choosing a Supreme Court nominee, that is…)

  3. Hardiman and Kavanaugh, the other putative finalist, are all of 53 years old. The ultimate pick, along with the 50-year-old Gorsuch, will allow Trump to forcibly cornhole the U.S. from beyond the grave (a la Tricky Dick Nixon and Wild Bill Rehnquist).

    1. BS.  Scalia wasn't supposed to drop dead ahead of time.  The court will still be 5-4 and losing one conservative will flip the court again.  It ain't the end times.

        The history of the Supreme Court generally and Rehnquist's tenure in particular establish quite conclusively that a president screwing over the country from beyond the grave in the person of his Supreme Court appointee is by no means limited to times during which the president's ideological kinfolk constitute a majority on the Court.

        The lure of holding forth on subjects about which we know nothing can be powerful. I succumb to it myownself all too often. But it's never a good idea.

  4. I disagree with them on almost every issue but I have to say, the right wingers know what they want, they know how to get it and they are willing to do absolutely anything necessary to achieve it.

    I wonder if the left will ever figure that out…… 

      1. Agreed big bird.  Why would we want to emulate the Lance Armstrong of politics.  Cheaters aren't worthy of emulation.  My vote is to compete on integrity and sensible solutions to the issues of our time.

  5. Kavanaugh it is. Seems like only yesterday he was a 38-year-old GOP partisan hack who got nominated to the U.S. Court of Appeals for the D.C. Circuit without any litigation or judicial experience. Back then, his signature accomplishment was co-authoring the Starr Report, which at the time was every Republican's favorite clown punching material.

    Trump will go with Amy Coney Barrett for his next appointment.

      1. One of the reasons I mention Jill Stein is because it a testament to the stupidity of the left.

        In 2000, lefties made a mistake. I actually knew people who voted for Ralph Nader because they didn't like Gore and, according the them, there wasn't much of a difference between Gore and Bush. That was a mistake, as events between 2001 and 2009 demonstrated.

        Doing the exact same thing over again only 16 years later isn't an innocent mistake. It is sheer stupidity.

        1. That’s fine – I actually agree with you that voting 3rd party in 2016 was a bad idea, which was why I didn’t. 

          Just don’t have any illusions that your constant scolding about it will bring any Steiner back to the establishment Dem fold -“hard lefties” as you call them are much too busy protesting on the urgent issues of the day – immigration (locking kids up in indefinite internment camps), now possibly losing the right to abortion and contraception, civil rights, etc.

          but if you want to keep venting your frustration, you’re entitled to do so – and I’m allowed to keep giving you pushback  when you minimize other factors like voter suppression and Russian meddling.

                According to this report from NBC News, the love affair between Jill Stein and the Russians was not a secret in the slightest, and reached back many years:

                Weiss said that Stein's foreign policy statements are also in synch with Russian interests. "Some of Stein's virulent pro-Russian rhetoric has barely gotten attention. Her talking points on hot button issues like the war in Ukraine look like she's reading off of a Kremlin-supplied script."

                "On the issue of war and nuclear weapons," Stein said, as RT reported, "it is actually Hillary's policies which are much scarier than Donald Trump who does not want to go to war with Russia."

                She even used RT to help launch her 2016 campaign for president. She announced her decision to form an exploratory committee on the U.S.-based RT program "Redacted Tonight" in February 2015.

                Watts also notes that it wasn't just Russia's overt propaganda organs that supported Stein. He says that the Russians used their "troll army" and computer-generated bots to place pro-Stein ads on Facebook and tweets on Twitter.

                 

    2. Kavanaugh is worse than most of the others. Wrote that Presidents should be immune from investigation and indictment (this, after working on the Starr investigation). Was against allowing a detained girl to get an abortion. Has a stated legal dislike of Obamacare.

      His record is sufficient to stoke the battle fires.

      1. Agreed.  Trump probably said to Kavanaugh "You had me at Presidential Immunity!"

        We’ll see if any Senator can extract a committment from Kavanaugh to recuse himself in any case that comes before the court (and there are many) involving Trump

  7. You know how when a child is being potty-training the youngster will proudly take mom or dad by the hand and lead the parent to the bathroom to show off the dump s/he just deposited? That's the 2018 version of the Vichy New York Times.

    On page one of today's Times, we read about how Kavanaugh's apparent belief that Vince Foster committed suicide (you know, as opposed to being murdered by the Clintons) is proof of how moderate he can be. And in yesterday's opinion section we saw the nominally liberal lawprof Akhil Amar shamelessly fanboying for his former student.

    Kavanaugh's nomination will experience no genuine opposition at all in the Senate, and only minimal just-for-show opposition.
